Covenants at Oak Hill Country Estates

It is the desire of the owners of this property to assure the initial development in the form of small acreages with high quality residences. It shall be a place where the future owners and their families may pursue small scale, part time agricultural and animal husbandry activities such as owning and riding horses, and 4-H and FFA projects for young people. It is further the intent of the restrictive covenants to assure the high quality of dwellings and other structures, to protect the health, safety, welfare, security of future monetary investments, and to further all things conducive to harmony and compatibility among neighbors. The following items are not all inclusive, nor are they couched in the legal language that will be required by the land sale legal documents. They will, however, give you an idea of the quality approach we are taking. None of these restrictions are meant to be overly intrusive but are intended to construct a pleasant environment for all residents.

1. All dwellings or other structures must be constructed on site and may not have been earlier erected at any other location. No mobiles and manufactured homes are allowed. No dwelling or structure may exceed two stories in height, basement not included.

2. Residences shall be single unit dwellings having an enclosed ground floor projected living area of not less than 2500 square feet for a single floor. Two story houses shall not be less than a total of 2800 square feet. Two story houses in which the second story exceeds the first story in square footage require a three car garage. Single story houses with a basement shall be considered as single floor dwellings with a main floor requirement of 2500 square feet. Such area does not include porches, garages, patios and breezeways. No T-111 siding or similar siding is allowed.

3. No outbuilding shall have a sheltered area greater than that of the dwelling. Outbuildings must be set away from dwellings by a distance of not less than forty feet and must be set back behind the front of the residence. All dwellings or other structures erected on the property must be completed as to external appearance including finished painting within one year of commencement of construction.

4. Purchasers must erect a white, three-rail vinyl fence on property perimeter within one year of the purchase of the property.

5. All utilities shall be required to be underground.

6. No Poplar or Cottonwood trees are allowed. Wind break trees or shrubs shall not exceed 20 feet in height. Such groupings of trees or shrubs shall not be planted more than 60 feet from a dwelling or more than 30 feet from an outbuilding. Care should be taken to not unreasonably interfere with the view of neighbors.

7. All security or landscape lighting shall be of a shielded type so as to preclude dispersion of light to the sides and vertically upward from the fixture. No such fixture shall be more than 12 feet from the ground.

8. No trapping, hunting, or discharge of firearms is allowed.

9. The property shall not be used for storage, for agricultural equipment (except for that specifically necessary for on-site maintenance), for construction equipment or rental equipment. No public garage, manufactory, mercantile business or repair occupation may be conducted as a significant part of the activity on this property.

10. It is the intent that owners may conduct limited livestock and poultry operations, the extent of which would be controlled essentially by the capability of the land to support such activities. In recognition of such, owners shall not maintain more than two large animals, either cattle or horses, two sheep (or lambs), two goats or two llamas per acre on the property. No pigs are allowed. A maximum of five chickens or other poultry will be allowed. All such animal husbandry efforts must be conducted in a creditable manner such that they will be of essentially minimum offensiveness or nuisance to neighbors, with particular reference to shelter, confinement, noise, and disposal of wastes. Dogs, cats or other household pets are allowed, provided they are not kept, bred or maintained for any commercial purpose.

11. All access roads within the development will be paved by developer. All private driveway approaches from the access roads shall be paved with asphalt, be 20 feet wide and run 20 feet from access road. Private driveways must be paved with asphalt or other approved material, and be a minimum of 12 feet wide from approach to dwelling and/or any outbuilding.
